These General Terms and Conditions of Sale and Use govern the use of the OCHSTIN website, available at ochstintime.com, and the sale of products made through it.
The website is operated by NOVA COMMERCE, a sole trader established in Bruguières, France.

Any order placed on the website implies acceptance of these terms.
1. Products
OCHSTIN mainly sells watches and watch accessories.
The essential characteristics of each product are presented on its product page.
We strive to present products as accurately as possible. However, slight differences in colour or appearance may result, in particular, from the settings of the screen used.
Offers are valid while stocks last.
2. Prices
The applicable prices are those displayed on the website at the time of ordering.
For consumers in the European Union, prices are displayed including all taxes where required by law.
Any shipping costs are shown before the order is finally confirmed.
For some international destinations, taxes, customs duties or import fees may apply in accordance with the regulations of the destination country.
OCHSTIN reserves the right to change its prices at any time, without affecting orders already confirmed.
3. Orders
The customer selects the products they wish to buy and adds them to their cart.
Before payment, they can check the content of their order, its total price and the information provided, and correct any errors.
The order becomes final once payment has been confirmed.
An order confirmation is sent to the email address provided by the customer.
OCHSTIN reserves the right to refuse or cancel an order in the event of suspected fraud, obvious error, payment incident or inability to fulfil the order under the conditions provided by law.
4. Payment
The available payment methods are shown when placing the order.
Payment is made through the payment providers available on our Shopify store.
The customer warrants that they are authorised to use the selected payment method.
The order can only be shipped once payment has been confirmed.
5. Delivery
OCHSTIN delivers to the destinations available at the time of ordering.
Processing time is generally 1 to 3 business days.
After shipment, the estimated delivery time is generally 5 to 8 business days.
These times may vary depending on the destination country, the carrier, customs formalities and busy periods.

6. Right of withdrawal
Where European Union law applies, the consumer in principle has 14 days from receipt of the product to exercise their right of withdrawal, without having to give any reason.

After notification of withdrawal, the product must be returned in accordance with the time limits and procedures provided by the applicable regulations.
Unless otherwise stated or covered by OCHSTIN, the direct cost of returning an item due to a simple change of mind is borne by the customer.

7. Refunds
When the conditions for a refund are met, it is made using the same means of payment as the original transaction, unless otherwise agreed.
When the legal right of withdrawal is exercised for the entire order, the refund also includes the standard shipping costs originally paid, in accordance with the applicable regulations.
We may withhold the refund until we have received the product back or until we receive proof that it has been sent, where permitted by law.
8. Legal guarantees
Products sold to consumers benefit from the applicable legal guarantees, independently of any commercial warranty offered by OCHSTIN.
Where French law applies, this includes in particular:
- the legal guarantee of conformity;
- the guarantee against hidden defects.
These guarantees are separate from any additional commercial warranty.

9. Defective or non-conforming products
On receipt of your order, please check the condition of the products.
If an item is damaged, defective or different from the one ordered, contact our customer service stating your order number.
Photos or videos may be requested where they help to examine the problem.
This procedure does not limit the consumer's rights under the legal guarantees.
10. Availability
Our products are offered while stocks last.
If a product becomes unavailable after an order has been confirmed, the customer will be informed as soon as possible and offered an appropriate solution, in particular a refund when the order cannot be fulfilled.
11. Use of the website
The customer agrees to use ochstintime.com lawfully and not to disrupt its operation.
Any fraudulent use, attempted unauthorised access or use likely to harm the website or its users is prohibited.
12. Intellectual property
The OCHSTIN brand, its visual identity, logos and the content of the website are protected by the applicable intellectual property rights and belong to their respective owners or are used with their permission.
Any unauthorised reproduction or use is prohibited.
13. Personal data
Personal data required to process orders and operate the website is processed in accordance with the applicable regulations.

14. Liability
OCHSTIN is responsible for performing its obligations under the conditions provided by the applicable regulations.
No provision of these terms may remove or limit any mandatory right granted to the consumer by law.
15. Governing law
These terms are governed by French law.
For consumers residing in another country, this choice does not deprive them of the mandatory protective provisions to which they are entitled under the law applicable to their situation.
16. Complaints and mediation
For any complaint, the customer must first contact OCHSTIN:

If a dispute remains unresolved after a prior complaint, the consumer may refer the matter free of charge to the competent consumer mediator for NOVA COMMERCE.
